TERMS AND CONDITIONS

1. The Service

4WDGrid is a GPS-based trip recording and community platform for four-wheel drive enthusiasts. The App allows you to record off-road trips, match your routes to known tracks, track your exploration progress, showcase your vehicle build, and engage with a community of drivers.

2. Eligibility

You must be at least 16 years of age to use the App. By creating an account, you represent that you are at least 16 years old and that the information you provide is accurate and complete.

3. Your Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately at support@4wdgrid.com if you become aware of any unauthorised use of your account.

You may not create accounts using false information, create multiple accounts, or transfer your account to another person without our consent.

4. Acceptable Use

You agree to use the App in accordance with these Terms and all applicable laws. You agree not to:

• Use the App while driving or operating a vehicle in any way that is unsafe or that distracts from safe driving. Trip recording is designed to operate passively — do not interact with the App while driving.
• Record trips that involve trespassing on private property, driving on closed tracks, or violating any local, state, or federal laws.
• Upload offensive, abusive, threatening, or inappropriate content including photos, captions, usernames, or condition reports.
• Attempt to manipulate leaderboards, badges, or statistics through fraudulent trip data, GPS spoofing, or any other deceptive means.
• Use the App to stalk, harass, or track other users. The App does not share real-time location data between users.
• Attempt to access other users' private data, reverse-engineer the App, or interfere with the operation of the service.
• Use automated systems, bots, or scripts to interact with the App.
• Create tracks or drive in environmentally sensitive areas, national parks, or protected land where off-road driving is prohibited.

5. The Trail Code

By using the App, you acknowledge the 4WDGrid Trail Code:

1. Tread Lightly — Stay on marked tracks. Never create new ones.
2. Pack It In, Pack It Out — Leave no trace. Carry all rubbish out.
3. Respect Closures — If a track is closed, turn around. No exceptions.
4. Be Prepared — Carry recovery gear, water, food, and a plan.
5. Travel With Comms — Carry a UHF, satellite communicator, or other means of emergency communication.

The Trail Code is a guideline for responsible off-road driving. Violation of these principles may result in content removal or account suspension at our discretion.

6. Trip Recording and Safety

The App is not a navigation device. Trip recording is a logging tool, not a GPS navigator. Do not rely on the App for navigation in remote areas. Always carry appropriate maps, a GPS device, and a satellite communicator for remote travel.

You are solely responsible for your own safety. 4WDGrid does not guarantee the accuracy of track data, condition reports, difficulty ratings, or any other information in the App. Tracks change over time due to weather, erosion, closures, and other factors. Always assess conditions in person before proceeding.

The Beacon feature is not an emergency service. If the App includes a beacon or location-sharing feature, it is provided as a convenience and should not be relied upon as a substitute for a Personal Locator Beacon (PLB), satellite communicator, or emergency services (000 in Australia).

7. User-Generated Content

You retain ownership of the content you create and upload to the App, including photos, captions, and condition reports. By uploading content, you grant 4WDGrid a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content within the App and for promotional purposes related to the 4WDGrid service.

We reserve the right to remove any content that violates these Terms, is offensive, or is reported by other users, at our sole discretion.

8. Trip Data and Contributions

When you record a trip, your GPS data is processed to match your route against known tracks, calculate statistics, update leaderboards, and contribute to aggregated, anonymised datasets. By recording trips, you acknowledge and agree that:

• Your individual trip data (route, distance, duration, statistics) is stored and displayed on your profile and visible to other users as described in our Privacy Policy.
• Your trip data contributes to anonymised, aggregated datasets including heatmaps and candidate track detection. These aggregated contributions cannot be individually reversed or withdrawn as they contain no personally identifiable information.
• The aggregated track database, heatmaps, candidate track data, and all anonymised datasets derived from user contributions are the intellectual property of 4WDGrid Pty Ltd.

9. Subscriptions and Payments

The App may offer free access, free trial periods, and paid subscription plans. Details of current pricing, features included in each tier, and trial terms are displayed within the App at the time of purchase.

Paid subscriptions are billed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID account settings.

We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect the current billing period of existing subscribers.

10. Intellectual Property

The App, its design, features, code, the 4WDGrid brand, logo, Trail Code, track database, scoring algorithms, and all aggregated datasets are the intellectual property of 4WDGrid Pty Ltd. You may not copy, modify, distribute, sell, or create derivative works based on any part of the App without our written consent.

The track database — including track geometries, names, difficulty ratings, and metadata sourced from public data and user contributions — is a compiled work owned by 4WDGrid Pty Ltd.

11. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the maximum extent permitted by Australian law:

• We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.
• We do not warrant the accuracy, completeness, or reliability of any track data, condition reports, difficulty ratings, maps, or GPS data provided through the App.
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to vehicle damage, personal injury, property damage, or death arising from your off-road driving activities.
• Our total liability to you for any claim arising from the use of the App is limited to the amount you have paid us in the 12 months preceding the claim, or $100 AUD, whichever is greater.

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited by law.

12. Indemnification

You agree to indemnify and hold harmless 4WDGrid Pty Ltd, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, your off-road driving activities, or your violation of any applicable laws.

13. Suspension and Termination

We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, upload inappropriate content, or behave in a way that is harmful to other users or the 4WDGrid community. We will make reasonable efforts to notify you before or at the time of suspension.

You may delete your account at any time through the App settings. Account deletion is permanent and your data will be removed in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the App and delete your account.

15. Governing Law

These Terms are governed by the laws of Tasmania, Australia. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of Tasmania, Australia.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court, the remaining provisions will continue in full force and effect.
